General Terms and Conditions of Sale for Consumer Customers

Article 1 – GENERAL PROVISIONS – SCOPE OF APPLICATION

1.1

These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") define the rights and obligations of the parties in the context of the online sale of Products offered by joswill (hereinafter referred to as the "Company").

1.2

Any order placed on the joswill website implies the prior and unrestricted acceptance of these General Terms and Conditions of Sale, which are governed by French law. These GTC form an integral part of the contract between the Customer and the Company. They are fully enforceable against the Customer, who acknowledges having read and accepted them without restriction or reservation before placing the order.

1.3

These GTC apply to any order placed by an individual of legal age acting as a consumer. The Customer therefore certifies that they are an individual over 18 years old, acting for purposes that do not fall within the scope of their commercial, industrial, craft, liberal, or agricultural activity. They confirm they have the full legal capacity to commit when placing an Order and agree to provide truthful information regarding their identity.

1.4 EXCLUSION:

These GTC expressly exclude professionals, meaning any natural or legal person, whether public or private, acting for purposes related to their commercial, industrial, craft, liberal, or agricultural activity, including when acting on behalf of or for another professional.

Professionals wishing to place an order with the Company are invited to contact us directly.

The GTC applicable to each Order are those in effect on the date of payment (or first payment in the case of multiple payments) of the Order. The Company reserves the right to modify these GTC at any time by publishing a new version on its website. The latest version of the GTC is available on the Company's website at the following address:

1.6 Consumer Mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, our Company has implemented a consumer mediation system. The designated mediation entity is:

Article 2 – CONCLUSION OF THE ONLINE CONTRACT

2.1. Order Process

To purchase one or more Products on the website, the Customer selects each Product and adds it to their cart. Once their selection is complete, they must confirm their cart to proceed with the Order (first click).

At this stage, the Customer is redirected to a page containing:

  • A summary of the selected Products, corresponding prices, delivery terms, and shipping fees. The Customer is responsible for checking and, if necessary, modifying the contents of their cart.
  • The present GTC, which must be read carefully before validating the entire Order.

The validation of the Order after verifying the cart and reading the GTC (second click) constitutes the conclusion of the contract, and the Customer acknowledges that this second click entails a payment obligation.

The Customer is then redirected to the payment page, where they choose between the available payment methods and proceed with the payment of their Order.

After validating their Order and making the payment, the Customer receives an email confirmation from the Company at the address provided when creating their account. This email includes, in PDF format:

  • A summary of their Order (selected Products, prices, delivery terms, and fees)
  • The precise identification of joswill and its business activity
  • The Order number
  • The terms, conditions, and withdrawal form
  • The present GTC in PDF format

In the event that the Order confirmation email is not received, it is recommended that the Customer contacts the Company via the contact form available on the website.

The Customer will then receive an electronic invoice, which they explicitly accept.

📌 Important: It is strongly recommended that the Customer keeps this confirmation email and purchase invoice, as these documents may serve as proof of the Contract.


2.2. Cases of Order Rejection by the Company

The Company reserves the right to refuse an Order for any legitimate reason, including but not limited to:

  • Non-compliance with the GTC
  • Ordered quantities not corresponding to a normal consumer use
  • Non-payment of a previous Order or an ongoing dispute regarding a previous Order
  • Suspicion of fraud on the Order (supported by a series of consistent indications)

Article 3 – PRODUCT SPECIFICATIONS AND AVAILABILITY

3.1 Product Specifications

The essential characteristics of the goods and their respective prices are made available to the Customer on the Company’s website, along with any usage instructions, if applicable.

While the Company takes reasonable measures to ensure accuracy, these specifications (except for pricing information) are provided by suppliers, and the Company declines all liability for any errors.

The specifications are presented in detail and in French. The Parties agree that any illustrations, videos, or photos of the Products offered for sale are not contractually binding.

The validity period of the Product offers and their prices is specified on the Company's website.


3.2 Product Availability

Product offers are valid while stocks last at our suppliers. The availability of Products is usually indicated on the Product’s specific page.

However, since the Company does not reserve stock (except for pre-ordered Products explicitly stated on the Product page), adding a Product to the cart does not guarantee its availability or price.

If a Product becomes unavailable after the Customer’s Order is confirmed, the Company will immediately notify the Customer via email.

  • The Order will be automatically canceled, and the Company will refund the amount paid for the unavailable Product.
  • If the Order includes other Products, they will be delivered, and the shipping fees will not be refunded.
